Terms and conditions

1. Scope

These terms and conditions apply to all orders placed by consumers and businesses via the online shops esim-global.de, esim-asien.de and esim-asia.com with TravelFon GmbH, Im Niersgrund 1, 47623 Kevelaer, Germany (“we”). Deviating terms of the customer do not apply unless we expressly agree to them.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code).

2. Subject of the contract

We sell prepaid data plans in the form of eSIM profiles for use abroad. The scope (data volume, validity, destinations, any minutes/SMS) is set out in the respective product description. The data connection is provided via partner networks on site; availability and speed depend on local network coverage. The validity period starts when the eSIM first connects to a supported network at the destination. Unused data volume expires at the end of the validity period.

Use requires an eSIM-compatible device without a carrier lock (SIM lock). The customer is responsible for checking the compatibility of their device before purchase.

3. Conclusion of the contract

The presentation of products in the shop does not constitute a legally binding offer but an invitation to order. By clicking the button “Order with obligation to pay” the customer submits a binding offer to purchase. The contract is concluded when the payment has been successfully authorised and we deliver the eSIM or confirm the order by email. The contract languages are German and English.

We store the contract text. The order details and these terms are sent to the customer by email and can be accessed on this page at any time.

4. Prices and payment

All prices are final prices in euros. There are no shipping costs. Payment is made in advance via our payment service providers Stripe or PayPal; the available payment methods are shown during the order process. The purchase price is due immediately upon conclusion of the contract.

5. Delivery

Delivery is exclusively digital: after receipt of payment the customer receives the eSIM (QR code and activation data) by email to the address provided and on the order confirmation page, usually within a few minutes. For technical reasons a QR code can only be installed once. The customer is responsible for providing a correct email address.

6. Right of withdrawal

Consumers have a right of withdrawal in accordance with the withdrawal policy. The right of withdrawal expires prematurely if we have begun performance of the contract after the consumer has expressly agreed that we begin performance before the end of the withdrawal period and has acknowledged that they thereby lose their right of withdrawal.

7. Warranty

The statutory warranty rights apply. If an eSIM does not work for reasons for which we are responsible, we will provide a replacement or refund the purchase price. In case of problems please contact support [at] reisesim.de.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. Otherwise liability is excluded. We are not liable for disruptions or restrictions of partner networks abroad over which we have no influence.

9. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country of their habitual residence. If the customer is a merchant, the place of jurisdiction is our registered office.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
